Nova Octo LLC (“Nova Octo”) knows that you (the “User”) care how information about you is used and shared. Protecting User’s private information is a top priority of Nova Octo. This Privacy Policy (“Privacy Policy”) governs how Nova Octo collects, protects, uses and shares User data on and through www.novaocto.com (the “Site”), the Nova Octo Showroom located at 88 Laight Street, New York, New York 10013 (the “Showroom”), and related services offered on or through the Site including product rental (the “Item(s)”), sale services (the “Sale Services”), and style consultations (the “Appointments” and, collectively with the Item(s), Sale Services and Appointments, the “Services”).

Please read this Privacy Policy carefully before starting to use the Site. By accessing and/or using the Site or any of the Services, User consents to the privacy practices described in this Privacy Policy and agrees to be bound by this Privacy Policy. If User does not want to agree to the terms of this Privacy Policy, User must discontinue using the Site and/or may not obtain or access any of the Services.

COLLECTION AND USE OF USER INFORMATION

Nova Octo may collect technical data (“Non-Personal Information”) from all visitors on the Site as well as information that User voluntarily submits to Nova Octo directly and/or through the Site (“Personal Information”). Any Personal or Non-Personal Information collected by Nova Octo, now or in the future, will solely by used to: (i) identify and communicate with User; (ii) respond to User inquiries; and/or (iii) provide one of the Services User has requested. Nova Octo will not use or share Personal Information or Non-Personal Information, except as may be described in this Privacy Policy. By using the Site, User agrees to the collection and use of Personal Information and Non-Personal Information in accordance with this Privacy Policy.

Account Information

To create an account on the Site, User will be asked to provide personal details about it/him/her, as well as shipping and billing information and credit card or debit card details. This data is required to complete an order on the Site and, if stored, is done so for this sole purpose. If User shares Personal Information such as measurements and style preferences with one of Nova Octo’s style consultants, this Personal Information will be stored to better serve User in the future and to provide User with a unique experience on the Site, in the Showroom, and/or via the Services.

Mailing Lists

Nova Octo stores User’s Personal Information (i.e. name, age, email address) for Nova Octo’s mailing list to keep User informed of promotions and new arrivals, and this Personal Information is safely stored on Nova Octo’s internal computer system. Nova Octo will never share this Personal Information with any third party without User’s prior consent. User may choose to opt out of receiving newsletters from Nova Octo by unsubscribing from Nova Octo’s mailing list.

Personal Information

In addition to the foregoing, the term “Personal Information” shall also mean any information that is related to an identified person, or that may be used to identify an individual, including, but not limited to: first and last name; email address; a home, postal or other physical address or other contact information; title, birth date, gender, occupation, industry, or personal interests; and other information necessary or useful to provide a one of the Services that the User has requested, including, but not limited to, utility account numbers and utility usage data. Personal Information is collected to offer a more customized experience for User when using or accessing one of the Services.

Non-Personal Information

In addition to the foregoing, the term “Non Personal Information” shall also mean any Information about a User’s computer hardware and/or software that may be automatically collected from User’s access of the Site. This information can include: the User’s IP address, browser type, domain names, access times and referring website addresses, This information is sued for the operation of the Services, to maintain quality of the Services, and to provide Nova Octo with general statistics regarding use of the Site. The Site may use cookies to enhance the User’s experience.

SECURITY OF USER INFORMATION

Nova Octo strives to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information Nova Octo stores, such as a firewall and encryption, in order to protect it from unauthorized access, destruction, use, modification or disclosure. However, User acknowledges that no method of transmission over the internet, or method of electronic storage, is 100% secure; Nova Octo is unable to guarantee the absolute security of Personal Information or Non-Personal Information. In the event Nova Octo discovers a security breach, Nova Octo will take all commercially reasonable action to stop the security breach and to notify User of it immediately. Nova Octo is not responsible for the security of Personal Information or Non-Personal Information to the Site over networks Nova Octo does not control, including the internet and wireless networks, and User hereby expressly waives any and all actions, proceedings or claims it may have against Nova Octo in relation thereto. Notwithstanding anything herein to the contrary, Nova Octo may share Personal Information with its authorized affiliates, vendors and subcontractors, in accordance with this Privacy Policy, to offer the Services, and with any legal authority if required to do so under applicable law.

COOKIES

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to User’s browser from a website and transferred to User’s device. Nova Octo uses cookies to collect information in order to improve the Services it provides. User can instruct its/his/her browser to refuse all cookies or to indicate when a cookie is being sent. The “Help” feature on most browsers provides information on how to accept cookies, disable cookies, or to notify User when receiving new cookies. If User does not accept cookies, User may not be able to use certain features of the Site; Nova Octo recommends User permit the use of cookies.

SERVICE PROVIDERS

User acknowledges that Nova Octo may employ third party companies and individuals to facilitate the Site, to perform Site-related services, and/or to assist Nova Octo in analyzing how the Site is used. These third parties shall have access to User Personal Information and Non-Personal Information only to perform specific tasks on Nova Octo’s behalf and are obligated not to disclose or use User Personal Information or Non-Personal Information for any other purpose. UNDER NO CIRCUMSTANCES SHALL NOVA OCTO BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR DISSEMINATION OF PERSONAL INFORMATION AND/OR NON-PERSONAL INFORMATION BY ANY THIRD PARTY REFERENCED IN THIS SECTION 4.

COMMUNICATIONS

Nova Octo may use Personal Information to contact User with newsletters, marketing, or promotional materials and other information that may be of interest to User. Nevertheless, Nova Octo respects User’s privacy and therefore gives User an opportunity to opt-out of receiving this information. LINKS TO OTHER SITES

The Site may contain links to other websites that are not operated by Nova Octo. If User clicks on a third party link, User will be directed to that third party’s website. CHANGES TO THIS PRIVACY POLICY

Nova Octo reserves the right to update and change this Privacy Policy at any time. By using this Site, User is expected to review the Privacy Policy on a regular basis to ensure User understands the policies governing the use of this Site. User’s continued use of this Site after Nova Octo posts any modifications to the Privacy Policy will constitute User’s acknowledgment of the modification(s) and User’s consent to abide and be bound by the modified Privacy Policy.
